What makes (most) people listen to music and appreciate this more than for example, a computer harddrive whirring or water waves all day?

Why are cover versions of songs ok, yet songs that are similar often result in a lawsuit?

I ask this because often songs that are similar, or contain parts, or riffs, or even a slightly different take result in a lawsuit.  However exact copies often chart many years later?
